<td><strong>It&#8217;s been said that no news is good news. </strong>But last week, the Jobs Report brought some good news for the labor market. Read on for the details&#8230;and what they mean for home loan rates.<img class="alignleft" src="http://www.mmgweekly.com/templates/mmgweekly/reg_chart/341/images/topimage.gif" alt="" width="430" height="268" />The headline Jobs Report showed 243,000 jobs created, which was much better than expected. Meanwhile, a whopping 257,000 private jobs were created, also much higher than expected. Upward revisions to November and December added another 60,000 jobs to what was previously reported for those months. And adding to the euphoria was a 0.2% decline in the Unemployment Rate, bringing it to 8.3%&#8230;the lowest since February 2009.Despite all this good news, the report did show a pretty sharp decline in the labor participation rate from 64% to 63.7%. We really need to have more people &#8220;participating,&#8221; or working to help pay down our debt. Understandably, the demographics of baby boomers retiring does account for some of the decline. But is it the entire 0.3%? And the U-6 Unemployment Rate (which counts all persons marginally attached to the labor force, including those who are employed part-time but would prefer full-time) remains at a lofty 15.1%, with that figure dropping just 0.1% for the month.</p>
<p>And there was other good news to note last week as well: The Commerce Department reported that Personal Incomes rose in December by 0.5%, above expectations and well above the 0.1% reported in November. This marked the largest increase in nine months!</p>
<p><strong><em>So what does all of this mean for the <span style="text-decoration: underline;">housing market and home loan rates?</span></em></strong></p>
<p>While Bonds and home loan rates did worsen on the good<strong><em><span style="text-decoration: underline;"> Jobs Report</span></em></strong> news (remember good economic news often causes money to flow out of Bonds and into Stocks, as investor try to take advantage of gains), home loan rates remain near historic best levels. In addition, the problems in Europe remainand as uncertainty reemerges, US Bonds (including Mortgage Bonds, to which home loan rates are tied) will benefit.</p>
<p>The takeaway from all of last week&#8217;s news is that the pace of improvement in the labor market is choppy and muddled at best. But the trend is improving over time, and this is welcome news for the struggling housing market because as people feel more secure in their jobs, they are more willing to consider making major purchases like a home.</p>
<p><strong><em>The bottom line is that now is</em></strong> <strong><em>a great time to purchase or refinance.</em></strong> <strong><em>Let me know if I can answer any questions at all for you or your clients.</em></strong></td>

<td>There are just two economic reports due for release this week and with earnings season winding down, the Stock and Bond markets will be battling over investing dollars.</p>
<ul>
<li>Thursday brings the weekly <strong>Initial Jobless Claims Report</strong>. Last week people filing for first-time claims fell by 12,000 to 367,000, an encouraging sign now that claims have fallen below that dangerously high level of 400,000.</li>
<li>On Friday, we&#8217;ll see the first reading on <strong>Consumer Sentiment</strong> for February.</li>
</ul>
<p>In addition, the Treasury will sell a total of $72 Billion in Notes and Bonds this week.</p>
<p>Remember: Weak economic news normally causes money to flow out of Stocks and into Bonds, helping Bonds and home loan rates improve, while strong economic news normally has the opposite result. The chart below shows Mortgage Backed Securities (MBS), which are the type of Bond that home loan rates are based on.</p>
<p><strong><span style="text-decoration: underline;">When you see these Bond prices moving higher, it means home loan rates are improving &#8211; and when they are moving lower, home loan rates are getting worse.</span></strong></p>
<p>To go one step further &#8211; a red &#8220;candle&#8221; means that MBS worsened during the day, while a green &#8220;candle&#8221; means MBS improved during the day. Depending on how dramatic the changes were on any given day, this can cause rate changes throughout the day, as well as on the rate sheets we start with each morning.</p>
<p>As you can see in the chart below, Bonds and home loan rates worsened after the Jobs Report was delivered on Friday. I&#8217;ll be watching closely to see what happens this week.</p>

<td><strong><em><span style="text-decoration: underline;"><a href="http://www.christianpenner.com/home-affordable-refinance-program-harp-enhancements-just-announced/">New Proposal to Help Homeowners Refinance&#8230;</a></span></em></strong><em></em><strong>But Will It Ever Get Off the Ground?</strong>The Obama administration has proposed a <strong><em><span style="text-decoration: underline;"><a href="http://www.christianpenner.com/home-affordable-refinance-program-harp-enhancements-just-announced/">national refinance plan</a></span></em></strong> in an effort to stimulate the housing market by helping those homeowners who are underwater on their <strong><em><span style="text-decoration: underline;">mortgages</span></em></strong>, or owe more on their loan than what the home is currently worth. Based on the proposal, the program would be available to responsible mortgage borrowers&#8230;and could save them up to $3,000 a year if they were to partake in the program.However &#8211; and this is very important &#8211; the plan is currently just a proposal and would have to be passed through both the Senate and the House of Representatives.<strong><em><span style="text-decoration: underline;">President Obama</span></em></strong> first introduced the plan at his <strong><em><span style="text-decoration: underline;">State of the Union Address on January 24th</span></em></strong> and stated just recently that this is a &#8220;make-or-break&#8221; moment for the middle class. The President said the program will cut through the red tape with no hidden fees.</p>
<p>There are, however, certain stipulations within the<strong><em><span style="text-decoration: underline;"> <a href="http://www.christianpenner.com/home-affordable-refinance-program-harp-enhancements-just-announced/">President&#8217;s proposal</a></span></em></strong>. The candidates would have to be current on their <strong><em><span style="text-decoration: underline;">mortgages</span></em></strong> for the past six months and could only have one missed payment in the six months prior to that. The candidate would have to have a credit score of at least 580. The loans would be backed into <strong><em>Federal Housing Authority (FHA) loans</em></strong> and would come from loans that are privately held, and would expand on the <strong><em><span style="text-decoration: underline;"><a href="http://actvra.in/lWP" rel="nofollow">Home Affordable Refinance Program (HARP)</a></span></em></strong> that is currently open to loans that are backed by <strong><em><span style="text-decoration: underline;"><a href="http://budurl.com/FannieMaeLoans" rel="nofollow">Fannie Mae</a></span></em></strong> and <strong><em><span style="text-decoration: underline;"><a href="http://budurl.com/FreddieMacLoans" rel="nofollow">Freddie Mac</a>.</span></em></strong> In addition, the loans would have to be 30-year conforming loans or loans that fall between $271,050 to $729,250 and the residence must be owner occupied.</p>
<p><strong><em><span style="text-decoration: underline;">The White House</span></em></strong> would also want lenders to take a &#8220;haircut&#8221; for those homeowners who are deep underwater. <strong><em><span style="text-decoration: underline;">Homeowners</span></em></strong> that are deep underwater could be more susceptible to foreclosure or to just &#8220;walk away&#8221; from their commitment to repay the debt.</p>
<p><strong><em><span style="text-decoration: underline;">Here&#8217;s an example</span></em></strong> of what the plan might mean to a homeowner, if the proposed plan were to be approved. On a $200,000 loan that is currently at 6%, the borrower would receive an interest rate of about 4.25%, which could amount to a savings of $216 a month on a 30-year mortgage. There would also be an option to move into a 20-year mortgage and &#8211; although the payments would not be lowered &#8211; it would provide an incentive to build equity and to pay off the loan in a shorter amount of time.</p>
<p>But before you get too excited or start making any plans, we have to remember that this is just a proposed idea at this time.</p>
<p>As with every new bill introduced to <strong><em><span style="text-decoration: underline;">Congress</span></em></strong>, there could be pushback for the plan, which is expected to cost as much as $5 Billion to $10 Billion. <strong><em><span style="text-decoration: underline;">The President</span></em></strong> said that the new plan would not add to the deficit; instead, the funds would come from a fee placed on large financial institutions. This has already gotten negative comments from Republicans in Congress. The White House said that other options to pay for the program would be considered.</p>
<p>This isn&#8217;t the first time that Capitol Hill has tried to combat the problems of underwater mortgages in the past few years and they have not been too successful. One big question is will the banks and servicers go along with the plan if it were to get through Congress.</p>
<p>In addition, the loans will be backed into <strong><em><span style="text-decoration: underline;">FHA loans</span></em></strong>. But, <strong><em><span style="text-decoration: underline;">FHA</span></em></strong> is on very shaky ground right now and is in no better shape financially than Fannie Mae and Freddie Mac. Some experts even think that <strong><em><span style="text-decoration: underline;">FHA</span></em></strong> may need a bailout in the near future.</p>
<p>The last thing this <strong><em><span style="text-decoration: underline;">Congress</span></em></strong> wants to do right now is to pass yet another stimulus bill, so many pundits see the proposal as &#8220;Dead on Arrival.&#8221;</p>
<p>In conclusion, an assortment of programs have been introduced to help struggling homeowners, and they have only had limited success. In order for this plan to get off the ground, it will need to be a joint effort by the White House, the lender, the servicer and the consumer&#8230; a feat that is always difficult to achieve when there are many moving targets and several different agencies involved.</p>

The whole country has suffered the past few years because of the problems created by the mortgage mess. The <strong><em><span style="text-decoration: underline;">housing industry</span></em></strong> is still struggling to get back on it&#8217;s feet.</p>
<p>In his <strong><em><span style="text-decoration: underline;">State of the Union address</span></em></strong> and in subsequent speeches <strong><em><span style="text-decoration: underline;">President Obama</span></em></strong> has been talking about his <strong><em><span style="text-decoration: underline;">&#8220;Blueprint for an America Built to Last.&#8221;</span></em></strong></p>

<p>While I want as much as anyone for the housing market to come back reading the plan I have to wonder if it&#8217;s a plan for recovery or a political document to help with getting elected.</p>

<p>A big talking point has been the <strong><em><span style="text-decoration: underline;">Homeowner Bill of Rights and the <a title="Blue Print For An America Built To Last" href="http://www.christianpenner.com/?attachment_id=1151" target="_blank">Blue Print for An America Built to Last</a></span></em></strong></p>
<p>The first two points are:</p>
<p><strong><em>Access to a simple mortgage disclosure form, so borrowers understand the loans they are taking out.</em></strong></p>
<p>In 2009 the government designed and mandated that the lending industry use the current Good Faith Estimate now given to borrowers. I took hours of classes learning to complete it correctly and real estate agents took hours of classes learning the new HUD1 form. I&#8217;d welcome a simple form but blaming the industry for the current confusion is just wrong.</p>
<p><strong><em>Full disclosure of fees and penalties.</em></strong></p>
<p>It seems they don&#8217;t know they also passed legislation holding lenders responsible for the fees that are disclosed to a borrower at application. A lender is financially responsible for under disclosing fees (even fees they don&#8217;t control) including those charged by title companies and state and count recording fees. Anyone who has been to a settlement is familiar with &#8220;Charges That Cannot Increase, Charges That in Total Cannot Increase More Than 10% and Charges That Can Change.&#8221;</p>
<p>The plan also calls for <strong><em><span style="text-decoration: underline;">Moving the Market to Provide a Full Year of Forbearance for Borrowers Looking for Work</span>.</em></strong></p>
<p>Now don&#8217;t get me wrong. This crisis has created a lot of pain for a lot of people and they need help. But is letting them not pay their mortgage for a year a solution to the problem or are we &#8220;kicking the can down the road&#8221; for someone else to worry about.</p>
<p>Who hasn&#8217;t heard Congress and the President rail against the abusive loans that caused the crisis. (A side note: all the loan types weren&#8217;t bad. They just got to liberal in underwriting and approving them)</p>
<p>The plan calls for <span style="text-decoration: underline;"><strong><em>Providing Non-GSE Borrowers Access to Simple, Low-Cost Refinancing</em></strong></span>. It has been proposed that &#8220;The refinancing program will be open to all non-GSE borrowers with standard (non-jumbo) loans who have been keeping up with their mortgage payments. The program will be operated through the FHA.&#8221;</p>
<p><span style="text-decoration: underline;">Simple and straightforward eligibility criteria.</span> Any borrower with a loan that is not currently guaranteed by the GSEs can qualify if they meet the following criteria:</p>
<p>* <em>They are current on their <strong><span style="text-decoration: underline;">mortgage</span></strong></em>: Borrowers will need to have been current on their loan for the past 6 months and have missed no more that one payment in the 6 months prior. (Sounds reasonable to me.)</p>
<p>* <em>They meet a minimum credit score.</em> Borrowers must have a current FICO score of 580 to be eligible. Approximately 9 in 10 borrowers will have a credit score adequate to meet that requirement. (If you want to get a new loan most loan programs want a minimum 640 FICO score. By meeting certain criteria you can lower the FICO score to 620.)</p>
<p><span style="text-decoration: underline;">Streamlined application process:</span> &#8221;To determine a borrower&#8217;s eligibility a lender need only confirm that the borrower is employed.&#8221; (Sound&#8217;s like the no-doc or no-income loan they have said were bad and don&#8217;t allow any more.) &#8220;Those who are not employed may be eligible if they meet other requirements and present limited credit risk.&#8221; (I&#8217;d love to know what those requirements will be.)</p>
<p>The program will be funded by &#8220;<em>Creating a separate fund for new streamlined refinancing program</em>. This will help FHA better track and manage the risk involved and ensure that it has no effect on the operation of the existing Mutual Mortgage Insurance (MMI) fund.&#8221; (So were taking loans that were made in the private sector and giving them a government guarantee and if they lose money well take it out of the left pocket instead of the right pocket? To me a loss is a loss)</p>
<p>Now to pay for the program the <em><span style="text-decoration: underline;"><strong>Refinancing Plan Will Be Fully Paid For By a Portion of Fee on Largest Financial Institutions:</strong></span></em> The Administration estimates the cost of its refinancing plan will be in the range of $5 to $10 billion, depending on exact parameters and take-up. The cost will be fully offset by using a portion of the President&#8217;s proposed Financial Crisis Responsibility Fee, which imposes a fee on the largest financial institutions based on their size and the riskiness of their activities &#8211; ensuring that the program does not add a dome to the deficit. (And do you thing &#8220;the largest financial institutions&#8221; are going to absorb that fee or is it more likely to be passed on to all consumers through higher fees and other cost. Are you aware the &#8220;Two month tax holiday passed in December is being paid with higher fees being charged by Fannie Mae, Freddie Mac and FHA. The new fees will be in effect for 10 years to pay for a 2 month thx holiday.)</p>
<p>I&#8217;ve been getting a lot of questions about <span style="text-decoration: underline;"><em><strong><a title="Harp 2.0 Refinance Program" href="harploanrefinance.com" rel="nofollow" target="_blank">HARP 2.0 refinancing program</a></strong></em></span> which was announced in November. It&#8217;s my understanding that the automated engines used to underwrite these loans will be ready in mid-March. I still an waiting to get details of what the requirements will be.</p>

<p>Three months after the Oba-ma administration announced a revolutionary refinance plan for severely<span style="text-decoration: underline;"><strong><em><a title="HARP 2.0" href="http://activerain.com/blogsview/2588215/great-news-for-underwater-homeowners-changes-to-harp-program-announced" rel="nofollow" target="_blank"> underwater homeowners</a></em></strong></span>, most borrowers are still unable to apply.</p>
<p>Technological barriers, as well as lingering questions about the new <strong><em><span style="text-decoration: underline;"><a title="HARP 2.0" href="http://www.christianpenner.com/?p=770" target="_blank">Home Affordable Refinance Program</a></span></em></strong>, have left many optimistic homeowners in a holding pattern as they watch interest rates bump around near record lows. <a title="For the Best Mortgage Rates Call Christian Penner 561-373-0987" href="bestrateswestpalmbeach.com" rel="nofollow" target="_blank">L<span style="text-decoration: underline;"><em><strong>ast week&#8217;s 3.98 percent for a 30-year fixed-rate loan </strong></em></span></a>marked the eighth consecutive week that the <span style="text-decoration: underline;"><em><strong><a title="For the Best Beast Rates Call Christian Penner 561-373-0987" href="http://BestRatesJupiter.com" rel="nofollow" target="_blank">average was below 4 percent</a></strong></em></span>.</p>
<p>But a mid-March update to automated loan approval systems at federal mortgage backers <span style="text-decoration: underline;"><em><strong><a title="Fannie Mae Loans" href="http://budurl.com/FannieMaeLoans" rel="nofollow" target="_blank">Fannie Mae</a></strong></em></span> and <span style="text-decoration: underline;"><strong><em><a title="Freddie Mac Loans" href="http://budurl.com/FreddieMacLoans" rel="nofollow" target="_blank">Freddie Mac</a></em></strong></span> should start things flowing, mortgage brokers said.</p>
<p>The automated systems are set to reject refinances on loans where the borrower owes more than 25 percent on the loan over what the home is worth &#8211; the limit under the old federal Home Affordable Refinance Program .</p>
<p><strong><em><span style="text-decoration: underline;"><a title="HARP 2.0" href="http://actvra.in/lWP" rel="nofollow" target="_blank">HARP 2.0</a></span></em></strong>, as the new program is sometimes called, has no cap for most refinances.</p>
<p>Until Fannie and Freddie update the underwriting program, banks that give refinances to severely underwater borrowers don&#8217;t know if the two enterprises will buy the loans or if the banks will be stuck with them on their books.</p>
<p>&#8220;If the loan is ineligible with Fannie, then you are underwriting it at your own risk, and it&#8217;s that risk that no one is willing to take,&#8221; said Tina Mulligan, vice president of the Florida Association of Mortgage Professionals. &#8220;You won&#8217;t see many applications being taken until probably after March 1.&#8221;</p>
<p><em><strong><a title="Fannie Mae Loans" href="http://budurl.com/FannieMaeLoans" rel="nofollow" target="_blank">Fannie Mae</a></strong></em> and <strong><em><a title="Freddie Mac Loans" href="http://budurl.com/FreddieMacLoans" rel="nofollow" target="_blank">Freddie Mac</a></em></strong> buy home loans from lenders with a guarantee against default and sell them to investors worldwide. They own or guarantee about half of all U.S. mortgages.</p>
<p>Only <span style="text-decoration: underline;"><em><strong><a title="Is my Loan A Fannie Mae Loan?" href="http://www.fanniemae.com/loanlookup/" rel="nofollow" target="_blank">Fannie Mae </a></strong></em></span>and <strong><em><span style="text-decoration: underline;"><a title="Is My Loan A Freddie Mac Loan?" href="https://ww3.freddiemac.com/corporate/" rel="nofollow" target="_blank">Freddie Mac</a></span></em></strong> loans are eligible for <strong><em><span style="text-decoration: underline;"><a title="HARP 2.0" href="http://www.christianpenner.com/home-affordable-refinance-program-harp-enhancements-just-announced/" target="_blank">HARP 2.0</a>.</span></em></strong></p>
<p>President Obama announced another new refinance program during last week&#8217;s State of the Union address that would allow privately held underwater mortgages to refinance.</p>
<p>The proposal, which would require approval from Congress, could save homeowners about $3,000 a year on their mortgage, Obama said.</p>
<p>&#8220;No more red tape. No more runaround from the banks,&#8221; he pledged.</p>
<p>To qualify for <strong><em><span style="text-decoration: underline;"><a title="HARP 2.0" href="http://www.christianpenner.com/home-affordable-refinance-program-harp-enhancements-just-announced/" target="_blank">HARP 2.0</a></span></em></strong>, borrowers must be current on payments, have no late payments in the past six months and no more than one late payment in the past 12 months.</p>
<p>While there have been delays, some lenders are making headway on <strong><span style="text-decoration: underline;"><em><a title="HARP 2.0" href="http://www.christianpenner.com/home-affordable-refinance-program-harp-enhancements-just-announced/" target="_blank">HARP 2.0</a>.</em></span></strong></p>
<p>Bank of America rolled out a program on Jan. 17, but only to its mortgage customers, said spokesman Terry Francisco. CitiMortgage and GMAC Mortgage also are accepting applications from their customers.</p>
<p>JP Morgan Chase spokeswoman Melissa Shuffield said the bank will begin processing HARP 2.0 refinances from its customers on Feb. 6. Wells Fargo does not have a timeline for implementation.</p>
<p>&#8220;We&#8217;re optimistic we can begin taking those applications within the next few weeks,&#8221; Wells Fargo spokesman Jason Menke said. &#8220;We don&#8217;t have a lot of specifics to share right now, but obviously we&#8217;re working to implement the HARP changes as quickly as possible.&#8221;</p>
<p>For homeowners whose loans are serviced by non-lending institutions, it could be mid-March before they can apply.</p>
<p>One benefit of the new<span style="text-decoration: underline;"><em><strong> <a title="HARP 2.0" href="http://www.christianpenner.com/?p=736" target="_blank">HARP</a></strong></em></span> is that homeowners who refinance into shorter-term loans should see interest rates that are comparable to those charged to borrowers who have equity in their home. Traditionally, the more underwater a homeowner is, the higher the risk and thus the <span style="text-decoration: underline;"><em><strong><a title="For the best Mortgage Rates call Christian Penner 561-373-0987" href="http://bestmortgagerateswestpalmbeach.com" rel="nofollow" target="_blank">higher the interest rate</a></strong></em></span>.</p>
<p>Also, fees will be reduced or eliminated for high-risk borrowers who refinance into loans shorter than 30 years.</p>
<p>&#8220;My office probably fields four to six calls a day on this program from people who are inquiring about it and asking when it&#8217;s going to be available,&#8221; said Jon Turla, president of the Tallahassee-based Florida Association of Mortgage Professionals. &#8220;We tell them it was announced, but as of right now we don&#8217;t have the ability to take applications or close the mortgage.&#8221;</p>
<p>&#8220;Yes, the full program doesn&#8217;t hit until right after St. Patty&#8217;s Day, but interested homeowners should not wait to begin the process,&#8221; he said. &#8220;Thousands of homeowners will be applying to take advantage at the same time.&#8221;</p>
